Welcome to Fox Honey Farm. These Terms of Service (the “Terms”) govern your access to and use of foxhoneyfarm.com and any purchase you make from us through the website (collectively, the “Service”). Throughout these Terms, “Fox Honey Farm,” “we,” “us,” and “our” refer to Fox Honey Farm. “You” and “your” refer to the person accessing the Service or placing an order.

Our online store is hosted by Shopify, which provides the ecommerce platform that allows us to offer our products and services to you. By visiting the website, creating an account, or purchasing from us, you agree to these Terms and to any policies incorporated by reference. If you do not agree, do not use the Service.

1. Eligibility and account responsibilities

You must be at least the age of majority in your state or province of residence to place an order, or you must use the Service with the involvement and permission of a parent or legal guardian. You agree to provide current, complete, and accurate information when you place an order or create an account.

You are responsible for safeguarding your account credentials and for activity under your account. Please notify us promptly through our contact page if you suspect unauthorized use of your account.

2. Products and food information

We make reasonable efforts to describe and display our products accurately. Because honey and other farm products are natural products, color, flavor, aroma, texture, and crystallization can vary by floral source, season, temperature, and batch. These natural variations are not defects. Images are illustrative, and screens may display colors differently.

Product availability, sizes, packaging, and descriptions may change without notice. Unless expressly stated otherwise, statements on the website are provided for general information and are not medical advice. Our products are not intended to diagnose, treat, cure, or prevent disease.

Honey should not be fed to infants under 12 months of age. If you have a food allergy, sensitivity, medical condition, or dietary concern, review the product information and consult a qualified healthcare professional before use. Contact us before ordering if you need additional ingredient or handling information.

3. Orders, acceptance, and cancellation

Your order is an offer to purchase. We may accept, reject, limit, or cancel an order in our reasonable discretion, including because of inventory shortages, pricing or description errors, suspected fraud, shipping restrictions, or an inability to fulfill the order. An automated order confirmation acknowledges receipt but does not by itself constitute acceptance. Acceptance occurs when we confirm shipment or otherwise expressly accept the order.

We may limit quantities purchased per person, household, account, payment method, or order. If we cancel an order after payment has been collected, we will refund the amount collected for the canceled portion to the original payment method.

If you need to request a change or cancellation, contact us as soon as possible. We cannot guarantee changes or cancellation after fulfillment has begun.

4. Prices, payment, and taxes

Prices are shown in U.S. dollars unless stated otherwise. Prices, promotions, and availability may change without notice. Applicable shipping charges and taxes are shown at checkout before you submit your order. You authorize us and our payment providers to charge the payment method you provide for the total displayed at checkout.

Promotional offers may be subject to additional terms and may not be combined unless expressly permitted. We reserve the right to correct pricing or other errors and, when appropriate, to cancel the affected order and issue a refund.

5. Shipping, delivery, and local pickup

Shipping and delivery estimates are estimates only and are not guaranteed. Delays may occur because of carriers, weather, high order volume, incorrect addresses, or events outside our reasonable control. You are responsible for providing a complete and accurate delivery address and for ensuring that delivery is permitted and reasonably secure at that location.

Additional shipping terms, including available methods and any order thresholds, are described in our Shipping Policy. Local pickup, when offered, is subject to the instructions and availability shown at checkout or communicated by us.

6. Returns, refunds, and damaged orders

Returns, refunds, replacements, and claims for damaged, missing, incorrect, or undelivered items are governed by our Refund Policy. Because some products are food items, health and safety rules may restrict returns of opened, used, or perishable products. Nothing in these Terms limits any non-waivable rights or remedies available to you under applicable law.

7. Wholesale and dealer purchases

Unless we agree otherwise in writing, these Terms also apply to wholesale or dealer purchases made through the Service. If a separate written wholesale, dealer, or supply agreement conflicts with these Terms, the separate agreement controls for the subject matter of that conflict.

8. Acceptable use

You may use the Service only for lawful purposes. You may not:

• violate any applicable law or the rights of another person;
• submit false, misleading, fraudulent, or unauthorized information or orders;
• interfere with the security, integrity, or operation of the Service;
• introduce malware or harmful code;
• scrape, harvest, or use automated means to access the Service except as permitted by law or by our written consent;
• circumvent access controls or attempt unauthorized access to an account or system; or
• use the Service or its content to infringe intellectual property or privacy rights.

We may suspend or terminate access for conduct that violates these Terms or threatens the Service, us, our customers, or others.

9. Intellectual property

The Service and its content—including text, photographs, graphics, logos, product names, design, and other materials—are owned by or licensed to Fox Honey Farm and are protected by applicable intellectual property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Service for personal, lawful shopping and informational purposes. No other rights are granted.

10. Reviews, feedback, and other submissions

If you submit a review, photograph, suggestion, feedback, or other content to us, you represent that you have the right to submit it and that it is accurate, lawful, and does not violate another person’s rights. You retain ownership of your content, but grant Fox Honey Farm a worldwide, non-exclusive, royalty-free license to use, reproduce, adapt, publish, display, and distribute it in connection with operating, improving, and promoting our business and Service, subject to our Privacy Policy and applicable law.

We may remove or decline to publish submissions that we reasonably believe violate these Terms. You are responsible for the content you submit.

11. Third-party services and links

The Service may contain links to or integrations with third parties, including Shopify, payment providers, shipping carriers, and social media or analytics services. Third-party products and services are governed by their own terms and policies. We are not responsible for third-party websites or services that we do not control. Review their terms before using them or providing information to them.

12. Privacy

Our collection, use, and disclosure of personal information are described in our Privacy Policy. Because Shopify hosts our store, Shopify also collects and processes personal information in connection with your use of the Service. Shopify’s processing of information through its consumer services is described in the Shopify Consumer Privacy Policy.

13. Availability, errors, and changes to the Service

We may correct errors, update information, or modify or discontinue any part of the Service at any time. We do not guarantee that the Service will always be available, uninterrupted, secure, or error-free. We are not obligated to update information except as required by law.

14. Disclaimer of warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE AND ALL INFORMATION MADE AVAILABLE THROUGH IT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

THIS SECTION DOES NOT EXCLUDE WARRANTIES OR RIGHTS THAT CANNOT LAWFULLY BE EXCLUDED, INCLUDING WARRANTIES THAT MAY APPLY TO PRODUCTS YOU PURCHASE UNDER CONSUMER-PROTECTION LAW.

15. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FOX HONEY FARM AND ITS OWNERS, EMPLOYEES, AGENTS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM OR RELATED TO THE SERVICE OR THESE TERMS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THE SERVICE, THESE TERMS, OR A PRODUCT PURCHASE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO FOX HONEY FARM FOR THE PRODUCT OR ORDER GIVING RISE TO THE CLAIM OR (B) $100.

THE LIMITATIONS IN THIS SECTION DO NOT APPLY TO LIABILITY THAT CANNOT BE LIMITED OR EXCLUDED UNDER APPLICABLE LAW.

16. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Fox Honey Farm and its owners, employees, and agents from third-party claims, damages, losses, liabilities, and reasonable costs arising from your unlawful use of the Service, your violation of these Terms, or your infringement of another person’s rights. This obligation does not apply to the extent a claim results from our own negligence, willful misconduct, or violation of law.

17. Governing law and disputes

These Terms and any dispute arising from them or the Service are governed by the laws of the State of Wisconsin, without regard to conflict-of-law principles. Subject to any non-waivable rights you may have, legal proceedings must be brought in a state or federal court with jurisdiction over Outagamie County, Wisconsin, and you consent to the jurisdiction of those courts.

Before filing a claim, you and Fox Honey Farm agree to make a good-faith effort to resolve the dispute informally by providing written notice describing the issue and requested resolution. This informal process does not prevent either party from seeking urgent injunctive relief or filing in small claims court when eligible, and it does not extend any legal limitation period.

18. Changes to these Terms

We may update these Terms from time to time. The revised Terms will be posted on this page with a new effective date. Changes apply prospectively when posted unless a different date is stated. Your continued use of the Service after revised Terms take effect constitutes acceptance of the revised Terms. The Terms in effect when you place an order will generally govern that order.

19. General terms

If any provision of these Terms is found unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger, reorganization, sale of assets, or transfer of the business. These Terms, together with the policies incorporated by reference and any order-specific terms, constitute the entire agreement between you and Fox Honey Farm concerning the Service.
